The text of the measure states that health care providers who attend when a baby is born alive in the midst of an abortion attempt must “exercise the same degree of professional skill, care, and diligence to preserve the life and health of the child as a reasonably diligent and conscientious health care provider.” The practitioner will provide care for any other live-born child of the same gestational age” and then “ensure that the live-born child is transferred and admitted to hospital immediately.”
This procedure expressly prevents the child's mother from being prosecuted.
“The mother of a live-born child described under subsection (a) shall not be prosecuted for a violation of this section, an attempted violation of this section, a conspiracy to violate this section, or an offense under section 3 or 4 of this title based on such violation,” it said. Pro-lifers denounced Fetterman's stance.

Anthony Pro Life America, wrote in response to Fetterman's post, “Dude, it's literally called the Born Alive Abortion Survivors Protection Act. The baby is born and breathes. And waving, and you voted to deprive her of “The life-sustaining health care she would have been entitled to if she had been born under any other circumstance.”
