“Another huge win for Tennessee and the state!” “This morning, a federal court ruled in our favor and invalidated the Biden administration’s radical new Rule 9 nationwide,” Tennessee Attorney General Jonathan Scrimetti said in a post on X.
“The court’s order represents a resounding victory for protecting girls’ privacy in locker rooms and bathrooms, and for the freedom to speak with biologically accurate pronouns.”
The ruling came months after supreme court Denied the Biden administration's emergency request to enforce parts of the new rule that would have included anti-discrimination protections for transgender students under Title IX.

The comprehensive rule was issued in April and made clear that Title IX's ban on discrimination “on the basis of sex” in schools covers discrimination based on gender identity, sexual orientation, and “pregnancy or related circumstances.”
The rule went into effect on August 1, and for the first time, the law states that sex discrimination includes conduct related to a person's gender identity.
This has led to more than two dozen public defenders suing over the rule, arguing that it conflicts with some state laws that prevent transgender students from participating in women's sports.
“When Title IX is considered in its entirety, it is abundantly clear that sex discrimination means discrimination on the basis of whether you are male or female,” the court's opinion said. “As this Court and others have made clear, expanding the meaning of ‘on the basis of sex’ to include ‘gender identity’ turns Title IX on its head.
