Trump's lawyers told Manhattan Supreme Court Justice Juan Merchan in the lawsuit announced Monday that they would appeal his ruling rejecting their efforts to dismiss the criminal case.

The motion argues that the appeal should automatically stay the ruling, scheduled for Friday, and that if Merchan does not agree, he should still grant Trump an immediate stay of the action pending the outcome of the appeal. It may take months to resolve this appeal.

In a statement on Monday, Trump spokesman Stephen Cheung said: “Today, President Trump’s legal team moved to stop the illegal ruling in the Manhattan witch hunt.”

“The Supreme Court’s landmark decision on immunity, the New York State Constitution, and other well-established legal precedent require that this baseless hoax be dismissed immediately,” Cheung said.

Trump is scheduled to be sworn in as president for his second non-consecutive term in the White House on January 20.
